u003cpu003eA brief examination of the proposed new regimeu0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u003c/pu003eu003cpu003eLA FORMEu003c/pu003eu003cpu003eThe proposed new regime is better organized than the current Articles 664 to 664-96. The number of the Articles has been reduced from 664-96 to 664-90. The Articles are less complex, less confusing and more user-friendly as compared to the current Articles 664 to 664-96.u003c/pu003eu003cpu003eLE FONDu0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u0026nbsp;u003c/pu003eu003cp align=left\u003eThe proposed new regime is innovative in the following ways:u003c/pu003eu003cp style=margin-left:14.15pt;\u003e(i)u0026nbsp;u0026nbsp;u0026nbsp; Article 664-68 provides for the legal mechanism u0026laquo; u003cemu003epour les immeubles comportant moins de dix copropriétairesu003c/emu003e u0026raquo;. The co-owners of the such a u0026laquo;u0026nbsp; copropriété u0026raquo; shall not recourse to the rigorous and costly process of the election of the syndic as it provides for a collegial mode of administration.u003c/pu003eu003cp style=margin-left:14.15pt;\u003e(ii)u0026nbsp;u0026nbsp; Articles 664-69 to 664-75 provide for special provisions for the u0026laquo; u003cemu003eimmeubles ou groupe du0026rsquo;immeubles destinés au logement social u003c/emu003eu0026raquo;. The Ministry of Housing will be in a better position to assist these u0026laquo;u003cemu003e syndicatsu003c/emu003e u0026raquo;. The accountability of the syndics will be embodied within the legal framework. Hence, this will enhance the good governance in this field.u003c/pu003eu003cp style=margin-left:14.15pt;\u003e(iii)u0026nbsp; Articles 664-76 to 664-83 introduce a new legal framework to assist the u0026laquo; copropriétés u0026raquo; with different levels of financial difficulties.u003c/pu003eu003cp style=margin-left:14.15pt;\u003e(iv)u0026nbsp; Article 664-76 provides for the appointment of an u0026laquo; administrateur provisoire u0026raquo; who may take u0026laquo; u003cemu003edes mesures conservatoiresu003c/emu003e u0026raquo; with a view to protect theu0026nbsp; u0026laquo; u003cemu003ecopropriétéu003c/emu003e u0026raquo;. It is interesting to note that the u0026laquo; u003cemu003esaisie u003c/emu003eu0026raquo; can be done by the u0026laquo; syndic / créanciers / des copropriétaires représentant au moins 15 % des voix u0026raquo; which is not the case under the present legislation.u003c/pu003eu003cp style=margin-left:14.15pt;\u003e(v)u0026nbsp;u0026nbsp; Article 664-82 provides for a procedure of u0026laquo; u003cemu003edésaisissement u003c/emu003eu0026raquo;, viz, the withdrawal of the management of the u0026laquo;u003cemu003e copropriétéu003c/emu003e u0026raquo; from the syndicat and the vesting of same with the u0026laquo; u003cemu003eadministrateur provisoireu003c/emu003e u0026raquo;.u003c/pu003eu003cp style=margin-left:14.15pt;\u003eThese new legal mechanisms will avoid that the whole u0026laquo; u003cemu003eimmeuble tombe en décrépitude u003c/emu003eu0026raquo; due to the bad faith of a handful of co-owners.u003c/pu003eu003cp style=margin-left:14.15pt;\u003e(vi)u0026nbsp; The proposed new regime is also innovative in the sense that it has brought changes to the u0026laquo; u003cemu003enature juridique u003c/emu003eu0026raquo; of the responsibilities of the u0026laquo; u003cemu003esyndicsu003c/emu003e u0026raquo;, viz, Article 664-44 al. 4 provides that u0026laquo; u003cemu003eà lu0026rsquo;occasion de lu0026rsquo;exécution de sa mission, le syndic peut se faire représenter par lu0026rsquo;un de ses préposés u003c/emu003eu0026raquo;.u0026nbsp; Under the current legislation, u0026laquo;u003cemu003e le syndic ne peut se faire représenter u003c/emu003eu0026raquo;.u003c/pu003eu003cp style=margin-left:14.15pt;\u003eUnder the proposed new regime, the syndic will not only be responsible under the Article 1382-1383 of the civil code but will also be responsible under the article 1384 al. 3, viz, u0026laquo; u003cemu003eleurs préposés dans les fonctions auxquelles ils les ont employés.u003c/emu003e u0026raquo;u0026nbsp;u0026nbsp;u003c/pu003eu003cp style=margin-left:14.15pt;\u003eArticle 664-54 provides that the u0026laquo; u003cemu003esyndic est tenu de souscrire à une police du0026rsquo;assurance u003c/emu003eu0026raquo;, which is not the case under the current legislation.u003c/pu003eu003cp style=margin-left:14.15pt;\u003e(vii) According to Article 664-36, the general assembly of co-owners can be convened u0026laquo; u003cemu003een toutes formes et transmise par tous moyens permettant du0026rsquo;établir la preuve de sa réception par le destinataire, en particulier par lu0026rsquo;utilisation, préalablement convenue, de la correspondance informatique u003c/emu003eu0026raquo;.u003c/pu003eu003cp style=margin-left:14.15pt;\u003eThe proposed new regime will simply legalize a common practice which is already being adopted by most syndics.u003c/pu003eu003cpu003eCONCLUSIONu003c/pu003eu003cpu003eIn my opinion, the present Articles 664 to 664-96 which are based on the French law of 1965 u0026laquo; u003cemu003eet son décret du0026rsquo;application du 17 mars 1967u003c/emu003e u0026raquo; are outdated.u003c/pu003eu003cpu003eThe new regime proposed by the Law Reform Commission is a panacea to the u0026laquo; u003cemu003ecopropriétésu003c/emu003e u0026raquo; which are in difficulties most particularly, the u0026laquo; u003cemu003ecopropriétésu003c/emu003e u0026raquo; which form part of the social housing. I have in mind the high-rise buildings constructed by the National Housing Development Co. Ltd more than 20 years back.u0026nbsp; I have also in mind the Alpha housing project by the Mauritius Housing Company Ltd in the early 1990u0026rsquo;s.u003c/pu003eu003cpu003eThis new legislation will help to avoid that the above-mentioned u0026laquo; u003cemu003ecopropriétés tombent en décrépitudeu003c/emu003e u0026raquo; like the ex-dockers flats.u003c/pu003eu003cpu003eThis new legislation will create a modern and a proper legal framework for the management of the u0026laquo;u003cemu003e immeubles collectifs u003c/emu003eu0026raquo;.u003c/pu003eu003cpu003eIt is high time that our current Articles 664 to 664-96 be repealed and replaced by the new proposed regime.u0026nbsp;u0026nbsp;u003c/pu003e
